The NDIS Commission is consulting on the legislative changes for the NDIS Act, with consultation activities running from October 2024 to March 2025. No reforms will be implemented before 1 July 2025.

Proposed quality and safeguarding amendments to the NDIS Act (Bill No.2)


The Disability Royal Commission’s Final Report highlighted the quality and safeguarding challenges that still exist for people with disability in the Australian community.

The Minister for the National Disability Insurance Scheme and Government Services the Hon. Bill Shorten MP has announced the second part of legislative reform for the NDIS Act. The proposed changes will significantly increase protections for NDIS participants and improve the quality and safety of supports for all participants.

What we want to know about


Further legislative reforms are proposed to keep NDIS Participants safe from fraudulent and negligent NDIS Providers and Workers, by strengthening the deterrence and compliance powers of the NDIS Commission. This responds to the recommendations of the Disability Royal Commission by ensuring the NDIS Commission has the necessary powers to better safeguard NDIS Participants from violence, abuse and neglect.

We have proposed 10 measures in three main areas:
1. Changes to the penalty framework and introducing statutory requirements;
2. Safeguarding measures; and
3. Information gathering powers.

We are seeking feedback on these changes, including how they would work in practice and how we can help Providers and Workers to understand the new obligations proposed.

Key terms:
  • NDIS Participants: people with disability who receive NDIS funding to access NDIS services and supports.
  • Workers: People delivering NDIS funded services and supports to Participants, regardless of how they are engaged or the service relationship. ‘Workers’ includes but is not limited to employees, sub-contractors, independent contractors and sole traders.
  • NDIS Providers: Individuals or Organisations that deliver supports and services to NDIS Participants.
